SmartEngage
1. Description.
1.1 Customer may supplement any Automation Bundles purchased by adding on SmartEngage on that account to manage its Engage outbound campaigns using voice calls or SMS/MMS messages, pursuant to the terms set forth in this Attachment.
1.2 Any of the components related to the calls or messages made with SmartEngage, including any telephone or toll-free number used for caller identification, will be purchased by Customer under the terms of the underlying Automation Bundle.
1.3 If Customer chooses to use a third-party campaign system to trigger an Engage action in a SmartFlow for outbound calls or messages instead of Engage, IntelePeer will consider such calls and messages outbound attempts (as defined in Section 2) for purposes of SmartEngage charges.
1.4 Customer may use any telephone or toll-free number available in its inventory, which may include any numbers obtained from IntelePeer or a third party.
2. Rates.
2.1 IntelePeer will make available to Customer the Service components of each SmartEngage Bundle based on the Rates, and associated conditions, outlined in the Customer’s Order Form.
2.2 The monthly recurring charge for SmartEngage will be based on the quantity of outbound attempts subscribed for the billing period. For purposes of SmartEngage charges, IntelePeer considers each attempt to utilize any SmartFlow with an Engage action to call or message a single contact as an outbound attempt by Customer, regardless of the outcome of the call or message. For avoidance of doubt IntelePeer considers any subsequent call made to the same contact to be treated as separate outbound attempts, regardless of whether an automated or manual retry. Any voice call considered an SmartEngage outbound attempt will also count as an Interaction for an Automation Bundle, if the call encounters a live answer (including calls where voicemail is treated as live answer).
2.3 An overage charge will apply for any outbound attempts in excess of the quantity identified in the Order Form.
3. Fair Usage Policy for SmartEngage.
Notwithstanding anything in this Agreement to the contrary, any Automation Bundle with which Customer uses SmartEngage will have a limited exception to its applicable Fair Usage Policy to allow for Customer to use an automated system in order to trigger its SmartEngage outbound attempts.
